网络环境下著作权合理使用制度探析

在网络环境下，网络自身所具有的无国界性、信息的高流动性等特点使得传统的合理使用制度难以平衡权利人与社会公众之间的利益，关于合理使用制度在网络环境下应当强化还是淡化的争论已成为近年来著作权领域激烈讨论的热点问题。在这种争论存续的过程中，我国的合理使用制度在网络环境下将何去何从？此乃本文拟探讨的主要问题。从宪法学和经济学的角度对网络环境下合理使用制度的存在价值进行了分析，并以实现权利人与社会公众的利益平衡为基础，对重构网络环境下的合理使用制度提出了若干建议。

Fair Use System of Copyright in Network Environment

The unlimited-range nature and high fluidity of network brought tremendous challenge to the traditional system of fair use,which make it difficult to keep the balance between the interests concerning author,transmitter and user of works.Therefore,a dispute concerning whether the system of fair use should be intensified or weakened in network environment has become one of the most imperative problem in copyright law.How to reform the fair use system in China is just the core of this paper.The paper analyzes the value of existence concerning fair use system in network environment from the view of constitutional law and economics,and puts forward several constructive suggestions based on the interest balance between the owner of copyright and the public.
