经济全球化形势下我国反垄断法对企业合并的规制研究

经济全球化正在引导一场轰轰烈烈的法律变革运动 ,而反垄断法作为市场竞争秩序的重要维护者 ,同样也不能回避这一最具挑战性的世纪话题。但我国的反垄断法迟迟未能出台 ,由此对企业合并进行规制这一当前刻不容缓的事情也不能作出相应的明确规定。针对这一现状 ,并结合经济全球化形势下企业并购所出现的特征对我国企业并购问题进行研究并提出相应的对策建议。

On Law of Anti-monopoly' Establishing Rules and Restrictions to the Enterprise Incorporation of China in the Process of Economic Globalization

Economic globalization is leading a vigorous campaign of reforms in law. Law of anti-monopoly, as an important protector for the market competition order, is also inevitably to meet this challenging topic. However, China has not made the law so that it is impossible to establish definite rules and restrictions to the incorporation of enterprises. In this case, this paper puts forward the coping strategies and suggestions from the analysis of features of enterprise cooperation in the process of economic globalization.
