| 摘 要： | 3Q大战使网络用户的民事权益再次被凸显热议,具体涉及免费软件产品上的信息财产权益、网络服务中的消费者权益、隐私与个人信息等人格权益、网络格式合同权益等问题。要加强和完善网络用户民事权益的保护,应着重注意：新增和完善相关立法,为网络用户提供权利基础和法律依据;强化司法规制、加强执法力度,为网络用户权益提供事后保障;增加网络信息法的课题投入与理论研究,为制度建设争取学术支持;加强信息法制宣传、培养网络法律意识,实现网络用户的自我防护;发挥行政政策的灵活功能,及时实施监督管理;培育网络伦理规范、完善社会监督机制,运用社会力量综合治理。
