医患关系社会法属性分析及法律适用

医患关系法律属性的界定是医事法律研究的最基本问题，对此法学界存在较大分歧。从社会法概念和产生背景入手，在客观和主观两个角度上分析医患关系的法律属性，医患关系既不是私法性质的民事法律关系，也不是公法性质的行政法律关系，而是社会法关系，对它应当采用以（（侵权责任法》为专门法律，其他法律为补充的调整方式。

On the Social Law Attribute of Doctor~Patient Relationship

The attrbute of doctor~patients legal relationship is the most basic problem in the medical law. On this issue, there are significant differences in the law circle.This article introduced the concept and background of social law, and analysed the attrbutes of doctor patient legal relationship from both the subjective and objective perspective, and concluded that it is not of cival legal relationship of private law nature, nor is of the administrative legal relationship of public law nature. It is the social law. It should be adjusted with the tort liability law as the main and other laws as the complimentary.
