略论清政府辖制新疆的法律——《钦定回疆则例》

《回疆则例》是清朝统一新疆后为有效辖制回疆地区而制定颁行的一部内容涉及政治、经济、宗教、司法管辖诸方面的重要的民族法规。作为清朝少数民族法制建设的主要成果之一和少数民族法律体系的一个重要组成部分,《回疆则例》以“因俗以治”为立法原则,在体例、内容、性质方面具有突出的特点,在清朝统治新疆前期为边疆稳定、国家统一发挥了重要的作用。

Stipulations for Uygur Xinjiang Made by Imperial Order was an ethnic laws formulated and carried out by Qing Government for effective control over Ouigour Xinjiang, which involved politics, economy, religion, and judicial administration. As a major achievement of ethnic judicial construction and a key component of ethnic law system, it adhered to the legislative principle of "administrating in accordance with local conventions" showing conspicuous traits in its style, content, and character. It had played a crucial part in stabilizing border area and the unity of the whole country during the early administration of Qing Dynasty over Xinjiang.
