公共行政伦理及其补救——来自政治委托代理理论的启示

社会契约模型的外在形态是社会与政府间的政治委托代理关系,而其内在价值是作为契约基础存在的伦理品格.政治委托代理系统活跃着伦理需求与伦理拒斥两大张力,两种力量的角逐成为公共行政伦理演进的内在动因.政治代理人能否基于国家根本制度的设计而谋求公益,真正负载起委托人(人民)的权力重托,构成中、西方公共行政伦理体系的根本分野.从政治委托代理结构着眼反思传统的行政伦理建设,推进观念变革、制度创新和组织重理,将是我国走向公共行政伦理化的必然路径依赖.

Public Administrative Ethics and Its Remedy

The outward appearance of society contract model is political agency by agreement between society and government, its inner value being the moral characters which exist as contract base. Two tensile forces of moral need and moral rejection exist in the system of political agency by agreement. The competence of these two forces becomes the inner factors for the evolution of public administrative ethics. This dividing line between the Chinese and western public administrative moral systems is whether the political agents can be entrusted with the people's rights and can realize public interests according to the country's basic system. Reflections on traditional administrative ethics construction from political trusting structure, pushing forward idea reform, system creation and reconstruction, these are the necessary paths for China to make public administration ethical.
