董必武法学思想的时代光辉与历史局限——纪念董必武诞辰126周年

董必武法学思想的确丰富和发展了社会主义法制理论,为新中国初期的法制建没作出奠基性贡献。其中强调司法工作重要、树立司法权威,法院独立审判只服从法律,重视程序正义、促进司法公正,检察法院公安三机关分工负责、互相制约,提高审判质量、杜绝冤假错案,培养法律工作干部、开展法律教育和法学研究等观点,在今天仍具有重要的指导意义;重视法律作用、没有法制不能成为一个国家,依法办事必须有法可依、有法必依的观点,更为今天依法治国方略的提出提供了理论基础。所以,在今天学习、继承和发扬董必武法学思想,仍然具有重要的现实意义。

Dong Biwu’s legal thought is indeed enriched and developed the theory of the socialist legal system and made a initial ground-breaking contribution to the new China’s legal system.The points of views which emphasizes the importance of justice,to establish judicial authority,independent of the trial court only to obey the law,attention to procedural justice,and promote justice,divided responsibilities of the three organs such as procuratorate,court and public security bureau,mutual constraints,to improve the quality of the trial,to prevent miscarriages of justice,training cadres for legal work,to promote legal education and legal research and etc,still take important guiding significance today.The points of views that emphasis on the role of law,no legal system can not be a country,working according to the law must have the law and use the law,provide a theoretical basis to the proposal of today’s govern the country according to law.So it still has important practical significance to learn,to inherit and carry forward Dong Biwu’s legal thought today.
