产品质量国家免检制度与驰名商标法律保护制度的暗合与制度假设

制度经济学理论对制度建构的刚性需求和法学理论对制度结构的宏观整合是完善现代社会法律制度的基础与内在动力。当前我国的产品质量国家免检制度存在着较大的制度缺陷和规范盲区,它与驰名商标法律保护制度在深层次上存在着制度价值上的暗合。＂价值—致归—理论＂的提出为这两种制度的整合与重构提供了理论基础。在这种制度需求下,逐步全面取消产品质量国家免检制度,代之以完善的驰名商标法律保护制度刻不容缓。

On the Tacit Correspondence between the National Inspection Exemption Policy and the Legal Protection System of Well-known Trademarks and Relative Institution Hypothesis

The rigid demand of institutional economics on system construction and the macro-integration on institutional structure by law theories are the foundation and the internal impetus to the perfection of the legal system of modern society.Currently,considerable institutional defects and blind spots in regulation can be observed in our national inspection exemption policy,which has a tacit system value correspondence to the legal protection system on well-known trademarks on a deep level.The emergence of value consistency theory has provided the theoretic foundation for the integration and reconstruction of the two abovementioned policies.With such institutional demand,a gradual overall abrogation of the quality-inspection exemption policy and the adoption of a legal protection system on well-known trademarks are advised to be implemented without delay.
