试论德治与法治的关系

文章论述了德治与法治是自律与他律 ,依法治官与以德治官 ,政治建设与思想建设 ,治心与治身 ,治标与治本 ,治远与治近的辩证统一关系。提出要正确处理二者的辩证关系 ,应当树立现代德治和法治观念 ,坚持“两手”抓 ,切实纠正和摒弃以人代法、德主法辅、重利轻义等不良思想倾向

ON RELATIONSHIP BETWEEN RULE OF VIRTUE AND RULE BY LAW

This paper expouds the reationship of dialectical unity between the rule of virtue and the rule by law from following aspects:virtue of law and virtue by law are with virtue, political improvement and ideological education, purification of ficials by law and with virtue, political improvement and ideological education, purification of mind and body, taking stopgap measures and effecting a permanent elimination,and soliving problems from a long term view or for short_term profits. The paper points out that to correctly handle the relationship between the two, we must foster the idea of modern rule of virtue and rule by law, persist in attaching equal importance to both of them, practically correct and reject such harmful trends as man representing law, putting virtue above law, and valuing interests but neglecting justice.
