刑事政策在刑法有权解释中的功能

刑事政策在刑事立法、司法领域的指导作用十分突出,在刑法有权解释方面亦发挥着重要作用。刑法立法解释是刑事政策得以表达和实现的工具;如何表达刑事政策,如何处理好刑事政策与刑法规定的关系,则是刑法立法解释制定过程中所必须予以考虑的关键问题。刑法司法解释是刑事司法活动的重要内容,从我国目前的刑事司法体制看主要包括规范性刑法司法解释和个别性刑法司法解释。在规范性刑法司法解释中,刑事政策的贯彻是自觉的,从一定意义上说,最高司法机关本身就是制定刑事政策的主体之一,作为国家权力的重要行使机关,它必然要通过各种司法手段来体现国家的基本刑事政策。在个别性刑法司法解释中,法官解释法律往往自发地与刑事政策相适应。

Criminal policy has a very strong directive function, which plays an important role in the criminal effective interpretations. Criminal legislative interpretation is the way to embody and realize criminal policy, so how to express criminal policy, and how to coordinate the relationship between the criminal policy and the criminal regulation, are the key element which should be considered in the legislative process. The criminal judicial interpretation is the important content of the criminal judicial actions, which includes normative criminal interpretation and specific criminal interpretation. In the normative criminal interpretation, the criminal policy is expressed and implemented consciously, because the supreme judicial organs, as the subjects which stipulate the criminal policy, will positively carry out the basic criminal policy. In the specific criminal judicial interpretation, the judge will interpret the law spontaneously to conform to the criminal policy.
