| 摘 要： | 陪审制度是国家审判机关吸收普通公民参加案件审判活动的一项司法制度。随着法律制度和监督机制的不断完善,陪审制度的作用越来越微弱,而其固有的缺点却不断显现。因此陪审制度的衰落成为一种世界趋势。我国的陪审制也曾发挥过重要作用,但随着法制建设的深入及其自身不足的不断突显,人民陪审制度的作用开始减弱。本文对陪审制度的几点学说加以评说,继而提出了一些改革措施以期从本质上变革现有人民陪审制度,使其更好地发挥法律监督作用。

| Abstract: | The jury system as a kind of judicial system is to take in the citizens to participate in the trial. with the legal system and the supervision developing, the jury system impacted less principally. Its defects have stocked out. It is a tendency to the decadence of the jury system and the same in our country. In this article, the author mainly remarks on the viewpoints about the jury system, in order to recommend the measures that can reform the jury system in essence and have an excellent impact on the legal supervision. |
