非讼程序的缺陷及其完善

在民事诉讼法的修订过程中,通常程序、制度的建设和完善一如既往地受到重视,非通常程序、制度的建构和完善则相对缺乏更深入的研究。我国对非讼程序不重视的态度导致现行民事诉讼法中非讼程序存在诸多缺陷,在适用范围上,模糊了非讼事件与诉讼事件及行政事件的界限,在救济方式上不具有可操作性,现行有关救济方式的规定形同虚设。本文重点论述了现行民事诉讼法中存在的缺陷,进而从几个方面阐述对现行非讼程序的完善,以期能为民事诉讼法的修订提供一个基本方向,以促进中国特色社会主义法律体系的进一步完善,实现推动社会主义法治国家建设进程的终极目标。

Defects and Perfection in Non-litigation Procedure

In the process of revising civil law,the usual procedure,the construction and improvement of the system are taken seriously as always,while the unusual procedure,the system construction and improvement are not relatively researched as the usual one.This kind of attitude led to many defects in non-litigation procedure of civil law.In the scope of application,it dimmed the bound between non-litigation and litigation incidents.In the ways of remedy,it does not have operability.Therefore,the current remedy patterns existed in name only.This paper mainly talked about the defects existed in the current-used Civil Law,it further related the perfection of non-litigation procedure from a couple of aspects to provide a basic direction for revising the Civil Law,to improve the law system in our country whose law system has a socialist characteristics and to push forward our country to become one with adequate legal system.
