| 摘 要： | 侦查机关与检察机关既有诉讼职能的一致性,也有职业思维与能力上的差异性。侦查权应然层面属于行使公诉权的检察机关,而具体实施侦查权的主体则应当多元化。在现有刑事诉讼体制不做大的修改之前提下,侦检关系的务实抉择是构建切实可行的侦、捕、诉联动机制,以使轻微刑事案件办理既符合诉讼效率的要求,又不偏离公正的轨道。

| Abstract: | There are the consistencies of the lawsuit function also the differences of the professional thinking be- tween the investigation organ and the procuratorial organ, and the investigation power ought to belong to the procu- ratorial organ that exercising the public prosecution power, whereas the specific body of implementation should be diversified. Under the existing judicial system not being made big changes, the pragmatic choice of the relationship between the investigation organ and the procuratorial organ is to construct the cohesive mechanism of the investiga- tion, arrest and prosecution, so as to make the minor criminal cases solved efficiently and fairly. |
