| 摘 要： | 民事责任制度对于实现建筑法的立法宗旨,具有不可替代的特殊机制和作用,而我国现行建筑法律责任体系中民事责任规范过于原则、简略,难以有效实现建筑立法的宗旨。因此,从确定性、合理性、系统性、可预测性诸方面完善建筑立法中的民事责任制度,确立其在建筑法律责任体系中的核心地位已是势在必行。

| Abstract: | The passage analyses the deficiency of the civil responsibility norms in our present construction laws,highlights the effect that the civil responsibility system has in realizing the legislative aim of construction laws and then raises some ideas to perfect the civil responsibility system of construction laws in its certainty,rationality,systematization and predictability. |
