| 摘 要： | 阐述了关于盗窃信用卡并使用的行为性质在我国刑法理论界争议较大的三种不同观点:盗窃信用卡并使用应定盗窃罪;盗窃信用卡并使用应定诈骗罪;盗窃信用卡并使用应按照牵连犯从一重罪处断。通过对三种不同的观点的透彻分析和理论探讨指出:盗窃信用卡并使用的行为性质以及按盗窃罪和牵连犯处断不妥,应定为诈骗罪。

| Abstract: | Talk about three different views of the behavior character of thieving credit card and application in our criminal law. The first one, thieving credit card and application is theft offence crime. The second one, thieving credit card and using is bilk crime. The third one, thieving credit card and using should be punished as implication offence. Analyzing and discussing the three different views in order to point that thieving credit card and using can't be punished as theft crime or implication offence. It should be bilk crime. |
