平等就业权简论

摘    要:平等就业权渊源于我国宪法,是劳动权和平等权共同派生的一个权利,平等就业权综合了生存权和发展权的基本人权特征,是一项具有社会性的重要权利。由于对平等就业权的重要性认识不足,我国实体法和程序法中规定得都不够明确,对侵犯平等就业权的行为缺乏专门的机构来监管,所以平等就业权目前仅处于应然状态,没有在社会实践中得到很好的维护。要切实保护平等就业权,必须尽快制定并颁布《促进就业法》,设立“平等就业权利保障委员会”,完善平等就业权的司法救济途径。

Abstract:Equal employment right originates from the Constitution of China as derived from labor right and equal right.It concludes the features of the basic human rights in survival right and development right.Thus it is an important social right.Due to insufficient understanding of the importance of equal employment right,China's substantive and procedural provisions in the law are not clearly stated.Violations of equal employment right lack of the expertise to monitor,so the equal employment right is only presented in natural state,and not well supported in social practice.For effective protection of the right of equal employment,we must quickly formulate and promulgate the "law for the promotion of employment" while establishing the "Equal Employment Rights Protection Board" so as to improve the judicial relief measures for equal employment right.
