论中国外资法与TRIMs协议的适应

TRIMs协议作为WTO一揽子协议之一 ,规范与贸易有关的投资措施 ,并对成员方的外资立法提出统一的要求。我国加入WTO后面临着如何使我国的外资法与TRIMs协议相适应的挑战。本文试从TRIMs协议对其成员方外资立法的基本要求和该协议本身的发展趋势出发 ,评价了我国目前外资法的现状和已经作出的应对 ,对我国外资法的进一步发展进行了分析

On the Adaptation of Foreign Investment Law in China to the TRIMs

As an essential part of the agreements in the WTO, the TRIMs regulates the trade-related investment measures and also demands for uniform foreign investment laws in its members. Upon China's entry into the WTO, one of the challenges is to make sure our foreign investment law be adapted to the TRIMs. We try to evaluate our present foreign investment law and the changes it has made, and to make a conclusion about the trend of our foreign investment law, based on the requirements TRIMs has on its members.
