| 摘 要： | 谈判民主是中国社会主义民主的重要实现形式.谈判民主法治化的理论基础在于政治妥协与契约精神.在中国民主政治实践中,谈判民主常运用于中央政府与地方政府间的谈判、政府与民众的谈判、非政府间主体的谈判及国际政府间谈判等活动中,且均应受相应法律的规制.谈判民主过程中出现的争端应当通过谈判本身及法律机制来解决.
