论我国妇女参政权实现之困境及对策——从国际人权法比较的视角

政治权利是妇女人权中最为重要的权利之一。目前许多国家为了确保妇女的参政权,都纷纷修改宪法或法律,规定了“最低比例制”。而我国目前在人大选举中,对妇女的参政权采取的仍然是弹性制,只是倡导性地规定“应当有适当数量的妇女代表”。这种制度安排影响了妇女的政治权利,与妇女“半边天”的社会角色不相适应。为此,我们应当在社会观念、法律制度、国际人权对话等方面努力,以推动妇女的整体人权事业的发展,从而为妇女的参政权的实现创造条件。

On the Dilemma and Countermeasures in the Realization of Women's Right to Participating Government and Political Affairs——in the perspective of comparative studies of international human rights

Political right is one of the most important among the human rights for women.In order to ensure this particular right for women,nowadays many countries are revising its constitution or law with the specific "system of lowest proportion." However,in the election of Chinese People's Congress,we still adopt an elastic system for women's participating in government and political affairs only with the initiative stipulation that "there should be proper number of women representatives." Such a system has offended the political rights for women,which does not suit the social role of women being "half sky." Therefore,we must make an effort in the aspects of social ideology,legislation and international dialogue on human rights so as to promote the development of over-all human rights for women and thus to create positive conditions for the realization of women's right to participating government and political affairs.
