| 摘 要： | 目的犯的目的是目的犯主观要件中的独立要素,其内容超出目的犯这种犯罪故意的认识范围,属于主观的超过要素.根据目的与构成要件行为的关系,目的犯可以分为断绝的结果犯与短缩的二行为犯;以刑法是否明文规定为标准,目的犯可以分为法定的目的犯与非法定的目的犯.
