| 摘 要： | 环境危机已经是世界性问题,解决环境问题必须依靠经济法律手段,排污权交易制度作为一项解决环境问题的经济法律镧度,在国外取得了较好的效果,如何将其"本土化"、最大限度地发挥其功效取决于交易主体的利益分配.在排污权交易实践中.交易主体成份复杂、利益多样.应通过法律予以平衡与协调,将影响主体利益的相关因素纳入法律调控范畴,从法律上确认摊污权,合理进行排污权的初始分配,通过环境合同维护各方利益,建立有效的监管体系,保障交易主体利益的合法、公平、最大、长久,从而体现该制度设置的价值.
