| 摘 要： | 竞业犯罪是市场经济社会里必然产生的一种犯罪，它对市场经济正常的竞争秩序造成极大的破坏．从刑法理论上看，竞业犯罪有其自身的特征．我国刑法根据我国现实需要，也对破坏竞争秩序的竞业犯罪作出了规定．但还存在一些不足之处，有待进一步加以完善．

| Abstract: | Business Competition Crime is the crime appeared in the society of the market economy. This crime destroys the natural order of business competition and it has its own intrinsic characteristics. Based on the theory of the Criminal Law of China, some stipulations about the business competition crime are prescribed. But they still have some weak points which need to be improved. |
