教唆犯属性的逻辑认定——兼论对我国刑法中教唆犯“二重性”说之评判及反思

共犯从属性说与独立性说是大陆法系共犯论中争论不休的课题,共犯从属性说以法益侵害说为基础,而独立性说则主张犯罪征表说。我国学者在分析教唆犯属性时,多对从属性说与独立性说的原始意义有所误解,从而试图对从属性说与独立性说进行折中,形成所谓的“二重性”说。按照传统大陆法系共犯论中的从属性与独立性的含义,从解释论的角度来看,我国刑法中规定的教唆犯符合共犯独立性说,从立法论的角度,共犯从属性说的主张更为合理。

On Logic Determination of the Trait of Abettor

The theory of subordinate accomplice believes that the punishment of the narrow accomplice is dependent on the behavior of the actor on the base of theory of benefit violation,while the theory of independent accomplice holds that the abettor should be punished according to the criminal conduct.The theory of duality tries to compromise the two.The author believes the stipulation about accomplice of Chinese criminal law conforms to the dual nature of accomplice(subordinate and independent).From the legislative point of view,the theory of subordinate nature of accomplice is more reasonable.
