法治的民间社会基础：浙江民间商会发展考察

近年来在民营经济得到迅速发展的同时,浙江民间商会因其在获取信息和协调成员行动方面的优势而获得长足发展。与民间商会发展所仰赖的社会合法性相比当下我国民间商会发展的法律环境令人堪忧,行业协会与民间商会之间缺乏公平的竞争平台。因此,明确商会的组织原则和组织机构,界定商会与政府的职能划分,规范商会活动及其法律责任,是创设商会发展良好法律环境的必要前提。民间商会构成中国法治的民间社会基础,其实践活动对当代中国具有重大的法治意义。

The Development of Zhejiang Folk Chambers of Commerce and its Legal Significances

The rapid development of private enterprises in China has spurred the leap-forward of Zhejiang folk chambers of commerce which have been playing a significant role in obtaining information and coordinating members＇ actions. Considering the social legality on which the development of folk chambers of commerce depends, the legal environment for the development of China＇s private enterprises has much to be desired： there is no arena for the fair competition between trade associations and folk chambers of commerce. The necessary perquisites for creating a wholesome legal environment for the development of commerce chambers are： making clear the organizational principles and institutions of commerce chambers, defining the distinction between commerce chambers and governments in their functions, and regulating the activities and legal responsibilities of commerce chambers. Folk commerce chambers constitute the folk social foundations of Chinese legal ruling, and thus their activities are of great legal significance in China.
