| 摘 要： | 著作权作为知识产权的一种,一直在寻求个人利益与社会利益的平衡发展。在网络环境下,传统著作权保护体制正经受着严峻挑战。本文通过分析网络环境下著作权保护所面临的新挑战及特点,归纳出网络环境下著作权保护所存在的焦点问题,如"临时复制"、"超文本链接"及"数字图书馆"等,并通过吸收借鉴国际公约、条约中有关著作权保护的先进经验,提出一套符合我国国情的、适宜在网络环境下实施的著作权保护新方案。

| Abstract: | Copyright is a kind of intelligent property right,always looking for the equilibrium development of both personal and social benefits.Under the network environment,the traditional copyright protection system is experiencing austere challenge.This text tries to analyze new challenge the copyright protection is confronted with under the network environment and its characteristics,then induce the existing problems,such as "temporary duplication","hypertext link" and "numerical library".Then it proposes a set of new protection plans of copyright which conforms to our state condition and is suitable to implement under the network environment,by absorbing model international convention and treaty related to the advanced experience of copyright. |
