| 摘 要： | 私有财产在我国当前的经济结构中占有十分重要的地位,必须通过法律手段进一步予以肯定和保护。宪法修正后,要将保护私有财产的精神具体落实到刑法中,立足于平等保护公私财产的观念基础之上,消除当前刑法体系中对公私财产保护存在的诸多逻辑混乱和相互冲突之处,结合实际,有效地选择合适的私有财产刑法保护途径。
