我国应加强对夫妻隐私权的法律保护

夫妻隐私权是一项主体特殊的隐私权。在我国 ,夫妻隐私权受到传统观念的挑战 ,受到“相互忠实”的挑战 ,现行《婚姻法》对夫妻隐私权的保护不力。我国必须加强对夫妻隐私权的法律保护 ,这有利于发挥法律的指引功能 ,克服传统观念的侵扰 ;有利于维护夫妻的人格尊严和人格独立 ,发挥家庭的积极作用 ;有利于和谐夫妻关系 ,维护婚姻的稳定。加强夫妻隐私权的法律保护 ,主要依赖于《婚姻法》的完善

The Legal Protection of the Privacy Rright Between Married Couples Should be Strenthened in China

The privacy right between married couples is one whose subjects are special.In China,this right is challenged by traditional concepts and loyalty,and not given enough portection by the present Marriage Law.The legal protection is to be strengthened.Thus,the directing funation of law can be brought into full play ;the interference of traditional concepts can be overcome;the personal dignity and independence of the couples can be maintained;and the relationship beween the couples can be harmonized.The strengthening of the legal protection depends mainly on the Marriage Law.
