WTO框架下的中国农村土地立法研究

土地资源是农村最重要的自然资源之一,是农业发展和农村建设的物质载体。农村土地立法的完善,关系到农民的切身利益,关系到新时期＂三农问题＂的解决,关系到我国＂十二五＂能否顺利全面建成小康社会的宏伟目标。加入WTO后,随着农村市场的开放和农村土地市场化程度不断加强,我国农村土地立法在土地所有权、使用权和流转权等方面的缺陷已经成为制约着我国农业发展的最大瓶颈。要以WTO确立的非歧视性原则、公平贸易原则、透明度原则等为指导,不断完善我国农村土地立法,提高我国农业的国际竞争力,促进农村经济的发展。

Rural Land Legislation in China under WTO Framework

Land resources,a vital natural resource in the rural areas,is considered the physical carrier for the agricultural development and rural construction.Perfecting rural land legislation is closely related not only with farmers＇ interest,but with the resolution of the issue of agriculture,the countryside and the farmers and the achievement of a well-to-do society in the twelfth five-year plan.Since China became a member of the WTO,market in the rural areas has become more open and the land there more market-oriented.Defects rural land legislation in terms of land ownership,land use right and land transfer right have become the bottleneck restricting the country＇s agriculture development.Therefore,it is important to improve China＇s rural land legislation,enhance the agricultural competitiveness in the international market and thus promote the development of rural economy under the guidance of the WTO principles of non-discrimination,fair trade and transparency.
