论农地流转相关法律制度的完善

农地流转是解决农地家庭承包制与集约化农业生产之间矛盾的必然手段,法律制度是确保农地流转的基本保障。然而,相关法律在调整农地流转时却存在诸多不足,需要完善：一是完善《农村土地承包经营法》,对土地投资入股的方式与风险、土地承包经营权流转的性质、农地流转的登记与农地流转的监管制度进行完善;二是完善《信托法》,增加土地信托的规定;三是完善《农民专业合作社法》,对成员的出资方式、合作社的法人性质、合作社及其成员的法律责任等问题进行完善。

On Perfecting Legal System of Agricultural Land Transfer

Agricultural land transfer can help resolve the contradictions between the household contract system of agricultural land and intensification of agricultural production.In the process,the legal system serves as the basic security guarantee.However,various deficiencies are found in the legal system on agricultural land transfer： First,＂Rural Land Contract Law＂ has to be improved to perfect the regulating system governing the risk and pattern of investing with agricultural land,the legal nature of the agricultural land transfer,and the registration and regulatory regime about the agricultural land transfer;Secondly,＂Trust Law＂ must also be improved to increase the provisions on Land Trust;Thirdly,＂Farmer Cooperatives Law＂ must be perfected to better define member＇s investing methods,the legal nature of Cooperatives,the legal liability of the Cooperative and its members,and so on.
