| 摘 要： | 只有准确地定义了行政垄断 ,才谈得上如何来有效地应对。本文将国内学者对行政垄断概念的描述进行了归纳整理 ,通过比较分析了界定行政垄断必须明确的几个问题 ,并据此提出了行政垄断的定义。虽然此定义亦存瑕疵 ,但不断寻求精确化的结论和解释是法律发展的目标 ,笔者正是希望能借此文起到一个抛砖引玉的作用。

| Abstract: | Effective countermeasures against administrative monopoly presuppose an accurate definition of it. By summarizing the concepts of administrative monopoly put forward by both domestic and foreign scholars and analyzing and comparing some issues that should be clarified, this paper attempts to give a tentative definition of administrative monopoly. |
