| 摘 要： | 作为<联合国反腐败公约>的缔约国,中国依照公约规定修改和完善相关刑事立法是应履行的国际义务.针对中国刑法中有关贪污受贿罪的规定与公约的规定存在诸多差异,从犯罪构成的四个方面提出具体的修改完善建议.

| Abstract: | As one of the contracting states pf UN Convention against Corruption,China is in duty bound to modify and improve correlative criminal legislation according to the Convention.In view of the differences between corruption and taking bribes crime in Criminal Law of China and UN Convention,this article brings forward concrete suggestions on modification and improvement from four constitutive elements of a crime. |
