论债权让与中通知程序的构建

债权让与中的通知表现出依据一定方式和手续产生特定结果的特点,属于广义程序的范畴,其中程序之启动与效应是判断其正当性的两项重要指标。转让人与受让人均可启动通知程序,但在效力上应有所差别;预先通知无效,"中间省略之通知"应为有效;通知程序在外部效应上,对第三债务人有绝对的约束效力,但不能对抗债权流通中的其他第三人;在内部效应上,其不应成为决定债权归属的要件。
