“主客一体”范式是当下环境法范式变革的主流话语,它试图通过伦理基础、人性假设和法学调整观的相关改变为环境法提供新的方法.它与“主客二分”一样,仅具有认识论意义.环境法需要建立一种以人为逻辑起点,以社会世界为发生场域,以社会技术为媒介工具,以系统性思维为实践论范式.实践论范式的核心理念是承认并坚持环境与人、社会之间具有相互影响、相互制约的互动关系.

Philosophical Thinking on the Environmental Law's Paradigm Shift

The paradigm,unity of host and guest,is the mainstream of environmental law’s paradigm shift,attempting to change the ethical basis,assumptions of human nature and legal adjustments concept to provide a new methodology for the environmental law.But the paradigm and the other paradigm called separating the subjective and the objective paradigm both are at the epistemological level.The environmental law should establish a new practice paradigm which set the human as the logical starting point,the social world as the place field,the social technology as media,and set the systematic thinking as methods.The core concept of practice paradigm is the interaction including the relation from environment,human and society.
