| 摘 要： | 文章分析了Trips协议下发展中国家的态度及面临的挑战.从知识产权保护的经济分析、私权与公益的博弈、同质与异构的调和中明确发展中国家知识产权保护的限度,并提出完善的建议,主张发展中国家知识产权保护应兼顾本国社会发展水平与国际统一保护标准.

| Abstract: | Is it a fortune or a disaster for protection of intellectual property rights? Where should we locate the protection of intellectual property rights in developing countries? This paper analyzes the attitude and the challenge of developing counties under Trips treaty.It demonstrates the limitations of the protection of intellectual property rights from the economical analysis of protection of intellectual property rights,the game of private rights and public interests,and the balance of similarity of nature and difference of construction.The authors also make proposals for the improvement and advocate that the protection of intellectual property rights in developing countries should take account of the stage of their own countries' social development and the standard of international unified protection. |
