构建我国海洋立法体系的思考

我国海洋法律体系已初步建立，但还存在诸如立法不完善，执法不到位、司法救济不充分等问题，尤其面对国家海洋权益争端的日益加剧，我国海洋法律体系的完善已经成为一个涉及国家安全层面的重大课题。本文对我国和国际上海洋法的现状进行分析，从立法的理念和思路等方面进行探讨，提出了进一步完善海洋法体系的构想。

On the Construction of Maritime Legislation System in Our Country

The maritime legislation system has established initially in our country. But there are still problems such as the imperfection at legislation; the enforcement of laws is not in place; the lacking of judicial aid and so on. Especially facing the aggravating conflict about marine rights and interests, perfecting the marine laws of our country has become the important issue in which the national security level involved. This article analyses present situation about law of the sea in our country and international, inquires into the legislative notion and train of thought, and tries to perfect the system of maritime legislation.
