| 摘 要： | 环境犯罪客体是环境犯罪区别于传统犯罪的重要特征.作者从对有关环境犯罪客体的观点的述评入手,认为传统的根植于"人类中心主义"思想基础上的刑法犯罪客体理论在环境犯罪客体的界定上有着严重缺陷;对环境犯罪客体的界定应当突破"人类中心主义"思想的狭隘性,立足于对环境利益的保护,即环境犯罪的客体应当是人与自然的生态关系受到破坏所反映的社会关系--环境权关系.

| Abstract: | The object of environmental crime is characteristics of this kind of crime that is different from other traditional crimes.The author mainly analyzes that the demarcating of the object of traditional crime based on the thought of "human first" is not suitable for demarcating the object of environmental crime.Demarcating the environmental crime,one should break the thought of "human first" and put the thought of environmental first in his mind and try to protect the environment from destroying.In all,the object of environmental crime is a relation-a relation of environmental rights,which is the social relation between human beings and natural ecocide. |
