| 摘 要： | 诉讼能否发挥应有功能 ,决定着整个诉讼体系在社会秩序控制体系中的作用。当代中国虽然实现了诉讼功能多元化的格局 ,但诉讼功能体系的内在结构和形式机制还不尽完善 ,制约了诉讼整体功能的发挥。进行合理恰当的功能设计 ,才能实现诉讼的本体功能与社会整体功能的和谐与统一 ,进而发挥其实现国家权力、实现法治等功能 ,取得最优的系统功能效果。当代中国必须构建具有现代品格的诉讼功能体系的具体目标 ,从观念到制度上确立形式化的诉讼功能体系的主导性机制

| Abstract: | Several defects undermining the functional system of Chinese lawsuit are elaborated.On this basis analysis is made of their causes,and proposals initiated as to the solid goal aimed at in pursuit of the lawsuit functional system with modern qualities.A set of reforming and improving efforts are required in order that the modern lawsuit can work systematically by combining its own function with the functions of exerting the power of state and law.To make it whole,feasible measures are also suggested. |
