| 摘 要： | 关于代位权行使的效力, 有入库规则说、平等受偿说、优先受偿说等几种观点。从立法目的、法律功能、法律成本和效率、其他债权人利益的保护、中国司法解释的性质和来源来说, 中国应选择优先受偿说的观点, 赋予代位债权人优先受偿权, 建立代位权上优先受偿权的现代理念。

| Abstract: | There are many opinions about the effect of exercision of right of subrogation, such as stock regulation, equal treatment and preferential payment. Consider from legislative interest and purpose, society effect of law, legal cost and efficient, benefit of other creditors, character and origin of judical interpretation, we should choose the opinion of preferential payment, vest substituted creditor priority of compension and creat modern systerm of priority of compension in right of subrogation. |
