| 摘 要： | 农村宅基地问题是我国物权立法中“具有中国物色”的一个问题,对于其是否可以流转,近年来学者颇有争议,本文立足于中国农村宅基地转让的客观实际,比较分析各方观点,从理论和实践两方面阐述允许宅基地自由流转的理由,并设计了宅基地流转的相关制度,以期能对宅基地流转问题的解决有所裨益。

| Abstract: | This article discusses the usufruct of the base of rural residence,an issue of distinctive Chinese characteristics in real law,which is subject to much controversy among the academia in recent years.With reference to hard facts as well as available standpoints,the article argues for free transfer of the usufruct of rural residence base in China.It then continues to offer a draft of the relevant system and responsibilities for consideration. |
