| 摘 要： | 社区矫正是刑事一体化思想的实体展开, 是优化刑法运作机制的内在要求。社区矫正的发展不仅是刑罚执行方式的改进, 还涉及刑法观念的更新、刑事政策的调整、刑事立法的完善、刑事司法权力的重构等深层内容。因此, 应以刑事一体化为导向设计社区矫正的发展路径。

| Abstract: | Community corrections are the substantial evolvement of the integrated criminal science. It is also the intrinsic request of the optimization of criminal law operation mechanism. The development of community corrections is not only related to the improvement of punishment execution mode, but also related to some deep-seated issues, such as the updating of criminal law conception, the adjustment of criminal policy, the perfect of criminal legislation, the redistribution of criminal justice power. Thus, we should design the development path of community corrections according to the idea of integrated criminal science. |
