法治理想的现实思考

法治建设已经是中国现代社会建设和发展过程中十分确定的方向，但是由于历史和传统化的原因，法治理想并不是中国社会内生之物，更多的是依靠外在教育和政府推进。理想主义对法治国家的建设具有重要意义，中国社会正在进行的依法治国建设如果不能培养出具有自己民族精神的法治理想，终究难以成为真正意义上的法治国家。

The Ideal Constitutionality Based on Reality

It is doubtless that rule of law in China should be deepened and developed. The ideal constitutionality does not occurred from the inside of Chinese society in view of history and traditional culture. So rule of law in China depends more on the education and the government's push than on others. After reviewing the re asons of the western ideal constitutionality, it is clear that China must form t he ideal constitutionality with national spirit. Otherwise, it is very difficult for China to become a truly legal state.
