| 摘 要： | 中国古代公法以人治精神为内核,以伦理原则为指导并显现着泛刑事化的外部特征。中国古代公法以维护皇权为宗旨。形成中国古代公法独有特征的原因主要包括:自给自足的自然经济、专制集权的政治模式、以伦理精神为核心的社会意识形态以及家国同构的社会组织结构。

| Abstract: | Chinese ancient public law regards the spirit of rule of men as its kernel, regards ethics principle as its guide and embodies the external characteristics of extensive criminalizing. Defending imperial power is the fundamental aim of Chinese ancient public law .The reasons of bringing about the unique characteristics of Chinese ancient public law mainly include that the natural economy of self-sufficiency, the political style of autocracy and centralization of state power ,the social ideology regarding ethics spirit as its kernel and the social framework of organization of family and state in similar structure. |
