人性假设与制度伦理的正义价值诉求

中国传统的集团文化形态是以人性本善的“礼”为核心 ,派生出了“以善抑恶”的善正义制度伦理 ,它内含着德治精神的设定身份、分别等级、增进和谐的“亲和”性正义价值取向。而西方的经济文化形态则是以人性本恶的“法”为核心 ,演绎出了“以恶抑恶”、“以恶增善”的法正义制度伦理 ,它内含着契约和法治精神的设定主体、分别物权、公平转让和各得其所的“分构”性正义价值取向。从历史的进程看 ,一个社会中集团文化和经济文化只有平衡协调发展 ,使集团原则和经济原则处于均衡状态 ,把对个人利益动力的驱使放在尊重集团原则维持秩序的基础之上 ,才会使社会秩序文化真正繁荣起来。所以 ,如何建构中国特色社会主义制度伦理的正义价值取向和基本理论 ,在弘扬本国优秀文化传统的同时汲取西方崇恶制度伦理的法正义诉求的合理内核 ,是一个亟待研究的课题。

The Appeal of Justical Value About Humanistic Supposition and Institutional Ethic

Chinese traditional group civilization has developed the justice of kindness of "restraining evil by kindness"as institutional ethic that connotes"affinity's"value tropism of justice about the spirit of governing by moral which is made up of enacting status,parting grades,enhancing harmony.However,from the core of law of humanity that is essentially evil,the Western economy culture's form deducts the justice of law of restraining evil by evil and enhancing kindness by evil as institutional ethic that connotes"respectively composing"value tropism of justice about contract and the spirit of governing by law which is composed of enacting subject,distributing products,fairly conveying and each gets his due.
