生态本位视域下的社会危害性理论

日益严重的环境问题对传统的发展模式提出了挑战,科学发展观要求人本位的内涵进一步深化,外延进一步扩展,将环境的生态价值纳入视野.作为我国刑法体系的基石,社会危害性理论尚不能适应当前社会背景下有效惩治环境犯罪的实践要求.只有实现社会危害性理论由人本位向生态本位的延伸,并以此为指导完善环境刑事立法,才能有效惩治环境犯罪,实现人与自然和谐相处的目标.
