推进生态文明建设的环境司法保障

在环境保护领域，我国一直实行行政处罚为主、司法保护为辅的制度。但仅靠行政手段制裁环境违法行为，暴露出了诸多不足，以司法手段介入加强环境保护迫在眉睫。在新的历史条件下，如何运用法治思维，切实有效地为推进生态文明建设提供环境司法保障，本文认为可以从提高司法惩治打击力度、开展环境公益诉讼并充分发挥环境公益诉讼制度的作用、加强法制建设、推动国家和地方的环境立法、通过行政执法与环境司法的接轨几个方面解决环境司法问题，为生态文明建设提供有效的法律保护。

The Protection of Environmental Justice for the Construction of Ecological Civilization

In the field of environmental protection, our country has been implementing the system of administrative punishment, with subsidiary judicial protection. However, there are many problems by relying on administrative means alone to punish envi- ronmental violations, and it is imminent that environmental justice intervene and effective legal measures be taken to promote ec- ological civilization construction. To achieve this goal, the following suggestions are put forward： strengthening judicial punish- ment, carrying out environmental public interest litigation and giving full play to the role of environmental public interest litiga- tion system, strengthening the legal construction to promote national and local environmental legislation, and the integration of administrative law enforcement and judicial practice.
