| 摘 要： | 古典政治经济学到自由主义法哲学的思想演进是对"资本立法"原则的辩护。从休谟、卢梭、斯密的古典政治经济学到黑格尔的法哲学,不仅奠定了现代法治的市民社会基础与经济学逻辑,而且深刻暴露了这种逻辑背后的现代性问题,马克思的政治经济学批判及其法哲学建构就是从这一问题展开的。
