| 摘 要： | 土地承包经营权无须登记即可设立,但登记是土地承包经营权物权性流转的对抗要件。土地承包经营权债权性流转不发生物权变动,无须登记。土地承包经营权证书仅是证明土地承包经营权存在的文件,不能起到土地承包经营权公示的作用,也就不能作为土地承包经营权流转的基础。现行有效的《农村土地承包经营权证管理办法》不能为土地承包经营权登记提供操作规范,应予完善。

| Abstract: | Land management contract right can still be established even without the registration.Yet,registration is an important antagonist in land management contract right transfer.There is no property right transfer in the land management contract right transfer,thus no registration is required.Land management contract right certificate is only a document to prove the existence of land management contract right.It has no function to publicize the land management contract,thus it can not be regarded as the foundation for land management contract right transfer.The current Regulation on Certificate of Rural Land Management Right,still effective,can not provide rules for registration of land management right and it shall be modified for such purposes. |
