| 摘 要： | 《粤港合作框架协议》是我国内地省份与香港特别行政区之间签署的首份综合性合作协议,是对《规划纲要》的具体落实和将CEPA协议推向纵深的有力之举。但从法理上分析,作为《框架协议》订立基础的《规划纲要》和CEPA协议目前在国内法上的法律性质和法律效力均不甚明确,使得《框架协议》自身的法律性质与效力的确定受到影响。为促进该协议目标的顺利实现,有必要完善相关立法,明确CEPA协议及《框架协议》相应的法律地位。 |
