网络个人数据安全刑法保护研究

大数据时代的到来凸显了“数据”的重要性，网络数据的安全随之成为一个重要的时代议题。在对大数据时代的网络数据安全进行研究的同时，必须注意到与个人信息紧密相关的“小数据”，这也是体现数据犯罪危害性的一个重要方面。网络数据安全与个人信息保护的融合成为事实，这为我国现有的公民个人信息保护的刑法体系在大数据时代的适用提出了新的研究问题。回顾了我国刑法在个人信息保护领域的发展历程，对现有的刑法规范进行了反思，通过对相关概念的细化和厘清，明确了网络数据的含义、范围和类型，结合《刑法修正案（九）》中相关条文的修改，提出了我国未来公民个人网络数据安全的刑法保护的完善路径。

Research on the Protection of Personal Data of Internet

The importance of data has been highlighted with the coming of Big Data Era,thus raising the importance of the security of the data of internet as an issue of the time.While researching on the security of internet data,it is neces-sary to pay attention to the “small data”which is closely related to person information,because that is also an important aspect indicating the harm of data crime.It poses a problem on the application of existing criminal legal system of the protection of personal information in Big Data Era,as there is an actual fusing of the security of internet data and the pro-tection of personal information.In this article,I look back to the development in the field of the protection of personal in-formation of Chinese criminal law,and rethink the existing legislation.By improving the fineness and clearness of the rel-evant concepts,the definition,scope and categories of internet data is more explicit and accurate.Taking into considera-tion of the revising of the relevant articles in the Amendment(IX)to the criminal law,it is possible to provide with con-crete approaches to the legislation consummates of the protection of personal data and personal information of Chinese criminal law.
