论国际刑事法院的司法正义结构

国际刑事法院的建立及其基本文件《罗马规约》的通过，标志着对于国际性刑事犯罪的管辖和处理进入了一个全新的发展阶段，这个证实正义理论的尝试性突破在国际司法正义实现的进程中起到积极作用。由正义与司法正义两者之间的联系凸显司法正义在实现正义过程的重要地位，而承载着实现国际司法正义重要使命的国际刑事法院及《罗马规约》其成立目的、机构运行的司法独立性质、法学理论视角下矫正正义与程序正义的充分结合使其在体现司法正义方面更优于以往国际刑事审判机构。

On the Judicial Justice Embodiment of the International Criminal Court

The International Criminal Court has been established and the Rome Statute has been taken effect. Hence, the international criminal jurisdiction and solution enter a new stage and the tentative breakthrough of verifying the justice theory plays a positive role in realizing the international judicial justice. This paper firstly illustrates the concept of justice and judicial justice and then elaborates the background and process of the establishment of Interna- tional Criminal Court.
